contacted the idiots insurance co. they said the guy already contacted them and they would have to have an investigation to see who was at fault. ipolitely told them it was the idiot that they were insuring fault. they took a statement from me besides asking some pretty stupid questions, like why was i only doing 25 in a 45 mph zone. i told them that i am not on the track and don't burn rubber everytime i start up from a red light and especially in the rain. the adjustors tune changed when i told her they were very lucky i wasn't hurt and that i have a police report that has the statements of the two eyewitnesses on it. this was on tues 3/31. in wednesdays mail i get an envelope from the municipal court and i figure the guy is trying to beat the ticket and i have to testify. instead the idiot went down and swore out 3 tickets against me. he is trying to put the blame on me. have to go to court and talk  to the prosecutor and explain the situation and asked that the tickets be dismissed. if they refuse, which after viewing the accident report with the officer citing him a ticket, i would be shocked if they don't dismiss them, then i will have to get a lawyer.

It sounds like you're up against a character who has had trouble with the law in the past and has some very good help in his corner.  Stick to your guns and good luck. 

sorry about not updating sooner but have had a bunch of things to get done. went to court on 4/14 and talked to prosecutor about dismissing the charges and told her that he is trying to blame me and explained what happened. she said in cases like this 95% of the time people try this. she said she could not drop the tickets as he will be acting as the prosecutor as it is a civil complaint.

courts today are like the show lets make a deal. as the judge is taking care of the guilty pleas, people are still making deals with the prosecutor. anyway i am sitting waiting and after about 2 hours judge calls my name and i go up front. he asks if the other driver is there and i tell him i didn't know and the guy steps up. the judge then says that under the plea agreement the guy made with the prosecutor all charges against me will be dismissed and his ticket will be reduced to careless driving instead of improper passing.

now i am waiting for his insurance co to pay me. they appear to be jerking me around. my sister works for a lawyer and they made a call and she said they were idiots. they are sending me the paperwork to file a suit if need be. will be calling his insurance co tomorrow one last time before filing the papers.

i am pissed as the weather has been great here (except for last week) for rides with the top off. hopefully this will light a fire under their butts to send me the check.

Man, that sucks.      You just know that azzz will get into another accident some day with his reckless nature.  I hope it works out with the ins. co., especially since he got cited for careless driving, which infers his blame for the accident.

it sure was his fault. cop thought so, two eyewitnesses and the court thought so. the only ones that won't is his insurance co. anyway, i called them and got the same answer so it was down to the county court house and i filed the suit papers this morning. maybe this will light the fire under their butts.

well here is the lastest update to this story. i guess the call from the lawyers office and then filing the suit, i got a message from allstate that they are accepting 100% liability and will be sending out the full amount of their estimators report. hopefully it should be here in a few days and then i will be getting it fixed. will be checking the mail everyday and hope they are done playing.

well everyone, this story is almost at the end. got the check from his insurance co and will be dropping the 90 off to the body shop tomorrow. he said it should take about 2 weeks. he will be repairing it plus he said he would paint the whole car for me and install door, b pillar, and rear window gaskets for me (which i will give him). can't wait to get it back..

That's quite a deal, good for you   Hopefully the azzz that hit you will get a nice increase in his next premium notice.
